A federal jury has awarded a Rensselaer, NY, truck driver $170,000 for being falsely arrested and prosecuted in connection with an incident seven years ago.
According to the Times-Union, trucker Frank McClellan and Steve Smith, who was a part-time officer for the Rensselaer County District Attorney's office at the time of the incident, got into a verbal dispute after Smith cited McClellan for opening his driver's side door into traffic while double-parked.
Smith, who was in plain clothes at the time, had driven by McClellan in his unmarked car, and had doubled back to issue him a citation.
However, McClellan said the officer approached him in a rage, shouting obscenities.
