Several truckers and trucking companies are suing the town of Fairfield, UT, because of the town’s weight limitation rules.
According to the Provo Daily Herald, the group of six truckers and trucking companies want an injunction against enforcement of the law because the law limits their access to their businesses.
The law limits the weight of trucks traveling along 1600 North, which is a common route for trucks in the town. There is another route that is 12 miles shorter, but a representative of the group told the Herald that road is not paved and is dangerous for trucks.
Fairfield’s law prohibits any truck weighing more than 4 tons per axle, or 36,000 pounds total. The ordinance is a temporary measure until the town is able to rebuild the road to withstand the heavier traffic.
The companies met with town officials during the summer to determine who should pay for repairs to the road, but no agreement was reached, the Herald reported.
The case has not yet been set for trial.
