Kentucky weight limit lawsuit dropped

A trucking company that was suing the state of Kentucky about a state law that allowed overweight coal trucks on state roads has dropped the suit, according to The Associated Press.

DRT Trucking filed the suit in 2004 against the state’s Justice and Public Safety Cabinet, but it has been inactive for months and would have been automatically dismissed by the state in November.

An attorney for DRT told The AP that the suit was filed last winter in an attempt to convince the General Assembly to pass a bill that would have expanded the weight exemption to include trucks hauling gravel, sand and other minerals.

The bill failed following a struggle in the legislature.

Leonard Lawson, owner of Mountain Enterprises, supported the bill and said earlier this year that he wanted heavier gravel truck weights to help 70 independent truck drivers who work for his company, according to The AP.

The bill was opposed by some legislators as well as citizen activist groups, who argued that heavier trucks on the roads would lead to more traffic deaths and road damage.
