Group files lawsuit to stop toll roads in Texas

A Texas anti-tolling group has filed a lawsuit against Gov. Rick Perry, the Texas Department of Transportation, and several local metropolitan planning organizations in an effort to halt the construction of toll roads in San Antonio and around the state.

The group, People for Efficient Transportation – PET for short – claims that the distribution of federal funds to build the toll roads violates the Texas Constitution because some state lawmakers are also on the boards of local metropolitan planning organizations.

According to local ABC affiliate KSAT-TV, the group claims this is a violation of the separation of legislative and executive branches of the government required by the state’s constitution.

The Daily Texan reported the group also claims the state plans to convert existing highways into toll roads and is “double taxing” the residents of Texas by doing so.

“This lawsuit is about accountability,” said Sal Costello, founder of PET. “We wouldn’t have filed any lawsuit without solid legal ground.”

The government, meanwhile, maintains that it has no plans to convert existing public roads into toll roads.
