Eight-time DUI offender gets five years in prison

An Oregon man has been sentenced to prison time after being convicted of his eighth drunken driving charge.

Michael Roy Archer was sentenced to five years in prison after being arrested for drunken driving on April 5. Police stopped Archer after witnesses reported seeing his van cross the center lane into oncoming traffic and traveling for more than 500 feet in the wrong direction, The Oregonian said.

Police said in reports that Archer smelled of alcohol, slurred his speech and fell backward out of his van after being pulled over, The Associated Press reported. Archer denied being intoxicated at the time and refused to take a breath test.

No one was injured in the incident, but several drivers did have to swerve to get out of Archer’s Way, The AP reported.

Archer faces the maximum penalty for a drunken driving charge. However, his sentence could be reduced to as little as three years and five months with good behavior and successful completion of an alcohol rehabilitation course, The Oregonian said.

Judge Marco A. Hernandez, who sentenced Archer, told The Oregonian that he hoped Archer could be rehabilitated with proper counseling, even though the chances were slim.

“I have very little optimism left that you will not return to drinking and driving,” Hernandez told Archer.

Hernandez ordered Archer’s license suspended for life, and issued a $2,000 fine for the violation. This is the first time Archer has faced prison time.
