Uninsured motorists who are injured in an auto accident cannot sue the other driver over those injuries, The New Jersey Supreme Court ruled Feb. 19.
The ruling involved a case of a couple whose insurance lapsed. Jorge and Mabel Caviglia were injured after their car was involved in an accident with a bus. According to The Newark Star Ledger, the court ruled against the couple, citing a 1997 law that forbad lawsuits of that type if they were filed by uninsured motorists.
The ruling forbids lawsuits even if the other driver is at fault, the newspaper said.
