Residents of an Indiana town say they are riled over the lack of enforcement of a 2000 law banning truck engine brakes. Police have not issued a citation since the law was passed.
Town folk near the Portage Toll Road complain that truckers continue to use the brakes whenever police aren't around to watch them. "In the middle of the night, (the engine brakes) will raise you right out of your bed," one resident told the Indianapolis Star.
After numerous complaints from area residents, Gov. Frank O'Bannon approved a law banning trucks from using engine brakes near the Portage toll plaza, punishable by up to a $500 fine.
Two years later, Indiana State Police say no citations have been issued for violation of the state statute since it took effect. Police blame a lack of personnel and truckers giving a heads up to each other of police presence before reaching the toll plaza.
To combat the state's inability to catch violators in the act, Rep. Duane Cheney (D-Portage) suggested state police work out a month-long period for full enforcement. State Police, though, said that likely will not happen because toll-road officers have too many other duties
