The Kansas Corporation Commission (KCC) assessed $54,200 in fines and penalties against 25 motor carriers for violations of Commission rules and regulations during the first three-quarters of the state's fiscal year.
In a published release, the KCC said the violations were discovered during safety compliance audits of 123 motor carriers, performed by the Commission's Transportation Division.
· Fined OK Transfer & Storage Inc., Wichita, KS, $2,000 for three safety violations. These violations included allowing a driver to operate a vehicle requiring a commercial driver's license without first receiving a negative pre-employment alcohol and/or controlled substance test result, transporting household goods without a Uniform Household Goods Bill of Lading, and using hourly rate billing instead of set rates posted in Motor Freight Tariff No. 40-N.
· Fined Ronald L. Miller & Joyce D. Miller, dba R&J Trucking, Almena, KS, $4,200 for six safety violations. These violations included allowing drivers to operate commercial motor vehicles more than 70 hours in 8 days.
· Fined A Box 4U LLC, Wichita, KS, $750 for allowing a driver to operate a commercial motor vehicle without being in a proper drug testing program.
· Fined H&T Trucking, Emporia, KS, $5,000 for five safety violations involving the falsification of driver duty status records.
· Fined Brumback Trucking, Ft. Scott, KS, $1,000 for failure to require drivers to record his/her duty status for each 24-hour period.
· Fined Thompson Cattle Co., Plainville, KS, $1,250 for failure to maintain driver qualification files for each driver employed, and failure to maintain records of duty status and all supporting documents for each driver for a period of six months.
· Fined Westland Energy LLC, Hays, KS, $2,850 for three safety violations. These violations included allowing a driver to operate a vehicle requiring a commercial driver's license without first receiving a negative pre-employment alcohol and/or controlled substance test result, and failure to maintain complete driver qualification files for each driver employed.
· Fined Barnhart Trucking Inc., Hiawatha, KS, $2,500 for three safety violations. These violations included allowing a driver to operate a commercial motor vehicle without a valid Commercial Motor Vehicle operator's license, and allowing a driver to operate a vehicle requiring a commercial driver's license without first receiving a negative pre-employment alcohol and/or controlled substance test result.
· Fined Collett Trucking, Marion, KS, $1,500 for operating a commercial motor vehicle without first implementing an alcohol and drug testing program, and operating a commercial motor vehicle with an expired Medical Certification card.
· Fined Samuel DeLarosa, SD Trucking, Valley Center, KS, $4,000 for four safety violations. Violations included allowing a driver to operate a commercial motor vehicle more than 60 hours in 7 days, allowing a driver to operate a commercial motor vehicle without maintaining a record of duty status when operating outside the 100 air mile radius, allowing a driver to be on duty more than 15 hours without first having an eight-hour break, and allowing drivers to operate commercial motor vehicles without being in a proper drug testing program.
· Fined Briggs Trucking Inc., Reading, KS, $700 for allowing a driver to operate a commercial motor vehicle more than 70 hours in 8 days.
· Fined Christino M. Garcia, Garden City, KS, $1,000 for failure to implement an Alcohol and/or Controlled Substance testing program.
· Fined Wheels Inc., Frankfort, KS, $500 for allowing a physically unqualified driver to operate a commercial motor vehicle.
· Fined Saker Towing, Ft. Scott, KS, $1,000 for two safety violations. These violations included failure to keep minimum records concerning vehicle inspection and maintenance, and failure to keep driver duty status records.
· Fined Professional Moving & Storage Inc. Lawrence, KS, $2,250 for three safety violations. These violations include allowing a driver to operate a commercial motor vehicle more than 15 hours without first having an eight-hour break, failure to require drivers to maintain duty status record, and allowing a driver to operate a commercial motor vehicle more than 10 hours without having eight consecutive hours off-duty.
· Fined LM Trucking Inc., Wichita, KS, $1,000 for allowing drivers to transport hazardous material without the required hazardous materials training.
· Fined AAA Housemoving, aka AAA Structural Movers, Wellington, KS, $11,500 for four safety violations. These violations included allowing a driver to operate a vehicle requiring a commercial driver's license without first receiving a negative pre-employment alcohol and/or controlled substance test result, failure to require drivers to record his/her duty status for each 24-hour period, failure to require drivers to prepare vehicle inspection reports, and failure to perform periodic vehicle inspections.
· Fined Wade's Automotive Center and Wrecker, Galena, KS, $900 for engaging in interstate commerce as an interstate exempt carrier without registering and being granted authority from the Commission, and failure to require drivers to record his/her duty status for each 24-hour period.
· Fined Servant Enterprises, Inc. dba Action Moving, Joplin, MO, $2,800 for four safety violations. These violations included operating as a household goods carrier without Commission authority, and failure to provide a Uniform Household Goods Bill of Lading to its customers.
· Fined JackRabbit Towing Inc., Norton, KS, $2,500 for three safety violations. These violations included failure to implement an Alcohol and/or Controlled Substance testing program, allowing a driver without current medical certification to operate a commercial motor vehicle, and failure to maintain individual driver qualification files.
· Fined R.E. Parks and Sons, Hugoton, KS, $500 for failure to require drivers to prepare vehicle inspection reports.
· Fined Derek Sumner Trucking, Norton, KS, $1,500 for two safety violations. These violations included failure to maintain individual driver qualification files, and falsification of driver duty status records.
· Fined Leo D. Stephens LLC, Colby, KS, $1,000 for allowing a driver to operate a vehicle requiring a commercial driver's license without first receiving a negative pre-employment alcohol and/or controlled substance test result.
· Fined R-Con Corporation, Wichita, KS, $1,000 for allowing a driver to perform safety sensitive functions without first receiving a negative pre-employment alcohol and/or controlled substance test result.
·Fined J-A-G Construction Company, Dodge City, KS, $1,000 for two safety violations. These violations included allowing a driver without medical certification to operate a commercial motor vehicle, and failure to perform periodic vehicle inspections.
