A female truck driver has filed a sex discrimination lawsuit against a Utah-based trucking company, alleging she was retaliated against and later fired after complaining about treatment she received as a trainee for Central Refrigerated Service Inc., of West Valley, UT.
According to court documents, Kathleen Robledo went to Central’s driver training school in Utah and was assigned a trainer. En route to Texas from Utah, Robledo alleges in the lawsuit that her trainer called her back to the sleeper berth and showed her a “pornographic/sexually explicit video on his computer.”
Robledo then alerted the company about the incident, but the situation was unchanged and she was still assigned to a truck with the same trainer. At some point, the trucking company notified the trainer of Robledo’s complaint. She alleges in the complaint that the trainer then “yelled at and belittled (Robledo) for being upset at his actions and for complaining to the home office and ultimately abandoned her at a truck stop.”
The complaint states a female driver for the same company was sent to pick Robledo up at the truck stop and drive her back to the company’s headquarters in Utah, where she filed a written complaint, and then drive her back to Beaumont, TX, where she contacted the Equal Employment Opportunity Commission to file a complaint.
“After (she) contacted the EEOC, the woman truck driver deserted (her) in Beaumont, TX, and left with (her) belongings,” the complaint alleges.
She claims in the lawsuit that she was later notified by the company that her position had been terminated.
In the lawsuit filed in U.S. District Court for the Eastern District of Texas in Beaumont, Robledo is seeking damages for back pay; reinstatement to her prior job and position; front pay, including employment benefits; compensatory damages, including economic losses, emotional pain and suffering; attorney’s fees and court costs.
