Federal court grants restraining order against Action Carrier

The U.S. District Court for South Dakota granted a restraining order this past week to immediately halt the operations of Action Carrier Inc. of Sioux Falls, SD.

The Federal Motor Carrier Safety Administration and the U.S. Department of Justice requested the order after the carrier allegedly refused repeatedly to comply with federal motor carrier safety regulations.

An FMCSA press release stated that Action Carrier has a history of continuing to operate after its authority has been revoked for failing to meet insurance requirements.

FMCSA officials say the agency has initiated three separate civil penalty proceedings against the company for operating without insurance and for operating after losing its authority.

The company’s authority was most recently revoked on Oct. 6, and the FMCSA officials say the agency has documented at least 16 incidents of illegal operation since then.

The next hearing on the case is scheduled for Tuesday, Nov. 25.
