Couple ordered to pay $45,000 for HOS violations cover-up

A couple who owned a Nebraska trucking company has been fined and ordered to pay restitution for their respective roles in an HOS violations conspiracy and attempted cover-up.

On Dec. 27, 2005, Rose and Robert Vyhnalek, former co-owners of R.J. Vyhnalek Trucking in Wilber, NE, were fined $12,500 each and ordered to jointly pay $20,000 in restitution by a U.S. District Court judge in Omaha, NE.

The fine and restitution stem from their conspiracy to violate FMCSA regs and for falsifying driver logbooks, respectively, according to a Department of Transportation Office of Inspector General press release.

According to the OIG, Rose Vyhnalek pleaded guilty in October 2005 to the felony conspiracy charge. She admitted to directing drivers to violate HOS rules. Robert Vyhnalek pleaded guilty in October to misdemeanor charges.

Richard Crawford, a driver and mechanic for the company was also fined $5,000 for falsifying driver logbooks subsequent to his October 2005 guilty plea, according to the release. FMCSA assisted with this investigation.
