The trial for the man accused of killing an Oklahoma truck driver in August 2003 began Monday, Dec. 5 in Columbus, OH.

According to WCMH-TV, police said Antonio Smith shot and robbed Michael Bailes, a trucker making a delivery to the Columbus area, Aug. 23, 2003. Bailes died several days later.

However, WCMH, the local NBC affiliate, reported that Smith’s attorneys claim that it was actually Smith’s older brother who pulled the trigger.

Prosecutors said they have no physical evidence against Smith and their only witness is Smith’s brother, who has already pleaded guilty.

The Columbus Dispatch reported that Bailes had been a driver for Wynne’s Transport of Omaha, NE, since 1999.
