An Indiana 18-year-old charged in the death of a Pennsylvania truck driver earlier this year was scheduled to appear in an Indiana court Tuesday, Dec. 6, and plead guilty to one felony count of overpass mischief.

Bobby Roberts of Indianapolis was arrested in April and charged with throwing a piece of concrete over an overpass onto Interstate 70 in Indianapolis.

The concrete struck the truck of Richard Rodriguez, crashing through the windshield and landing on his chest. Rodriguez was able to stop the truck and crashed. He died two days later of his injuries.

The charge pending against Roberts usually carries a maximum penalty of 20 years, but that was lowered to 15 as part of the plea agreement, according to The Indianapolis Star. Roberts could also face a fine of up to $10,000.

Roberts has been in jail since his arrest in April.
