A truck driver involved in Chicago’s scandalous Hired Truck program has been sentenced to five years’ probation.

Donald Warren, a former driver for BBD Trucking Co., was sentenced to the probation Wednesday, despite prosecutors’ attempts to have him serve jail time, the Chicago Tribune reported.

Warren pleaded guilty in June to stealing city asphalt and taking bribes from city foremen. However, U.S. District Judge Ruben Castillo said Warren’s crimes did not justify a prison sentence, the Chicago Sun-Times reported.

According to the Tribune, Warren, along with four other defendants involved in this aspect of the investigation, will be responsible for $9,600 in restitution for their crimes.
