FMCSA and carrier enter settlement agreement

The Federal Motor Carrier Safety Administration and Calco Express Inc., Green Bay, WI, have tentatively settled an enforcement action stemming from Calco’s reported use of a driver known to have tested positive for a controlled substance.

The claim for $18,910 was served Nov. 25, 2002. The June 25 settlement says Calco agreed to pay the FMCSA a negotiated amount of $15,000 in six consecutive monthly installments.

The payment schedule begins in March 2003. The agreement is not binding until executed by the agency’s enforcement program manager.

“(Calco) acknowledges that it has received adequate notice of the FMCSA’s claim and waives any and all rights it may have to further notice or to further details of the allegations that give rise to the claim,” the settlement said.
