Port truckers awarded nearly $6 million in wage dispute

A hearing officer for California’s Division of Labor Standards Enforcement recently awarded nearly $6 million for back wages to 24 port truck drivers.

In separate decisions, California Cartage Express was ordered to pay 14 drivers a total of $3,734.341.74, and California Multimodal LLC was ordered to pay 10 drivers a total of $2,172,889.99.

In both instances, the DLSE determined that the defendants did not meet its burden of proof on its defense that the truck drivers were independent contractors and not employees.

The drivers were awarded for unpaid wages, unreimbursed expenses, meal and rest breaks, waiting time penalties, liquidated damages, interest, and attorney fees.

New Jersey-based National Freight Industries recently acquired California Cartage. The decision is expected to be appealed.
