The bad actor EOBR mandate may have been struck down by the court, but it remains unclear what FMCSA will do with another proposed EOBR reg.
The agency proposed a 100 percent mandate of EOBRs for all trucks operating in interstate commerce back in January. Truckers had 60 days to file comments with the agency.
In addition to mandating the use of EOBRs in all trucks, FMCSA also proposed to reduce the amount of supporting documents motor carriers are required to validate hours-of-service compliance.
It is unclear what impact the court's decision has on this rulemaking. The agency is still planning on moving forward with a final rule according to a September report on upcoming regulations. The anticipated publication date of the final rule is in June 2012. LL
